Common Workers Compensation Questions
How Much Compensation Can I Claim?
The amount you can claim in Queensland depends on factors such as the nature and severity of your injury, average weekly earnings, and circumstances. Generally, for weekly compensation payments, you may receive up to 85% of your normal weekly earnings (NWE) for the first 26 weeks, which then reduces to 75% for the subsequent period. Additionally, if your injury is a permanent impairment, you could be eligible for a lump sum payment based on your degree of impairment.
If your injury was through employer negligence, you could pursue a common law claim for damages, including compensation for economic loss, suffering, pain, and medical expenses.
How Much Time Do I Have to Claim for a Work Injury?
In QLD, you have 6 months from the date of the illness or injury to lodge a claim.
- If the injury worsens over time, the six months start from your first Doctor’s consultation.
- If you have just been to the Doctor and assessed as not being fit for work, you have up to 20 business days to lodge your claim and waive the 6-month timeframe.
- If you are unable to lodge a claim within the timeframe, you can request an extension, but you will need to give a valid reason for failing to lodge in time.
If you intend to sue an employer for negligence, a notice of claim for damages must be submitted within 3 years of the injury.
In any case, it’s vital to seek WorkCover legal advice as soon as possible to ensure your rights are fully protected.
